1. कार्यकाल और पुनर्नियुक्ति (धारा 13(1) और 13(2))

Section 13(1): The Chief Information Commissioner shall hold office for a term of five years and shall not be eligible for reappointment. However, he shall not hold office after attaining the age of sixty-five years.
Section 13(2): Every Information Commissioner shall hold office for a term of five years or until he attains the age of sixty-five years, whichever is earlier, and shall not be eligible for reappointment as such Information Commissioner.
Provided that: Every Information Commissioner shall, on vacating his office, be eligible for appointment as the Chief Information Commissioner. However, his total term of office as both an Information Commissioner and the Chief Information Commissioner shall not be more than five years in aggregate.

धारा 13(4): वे किसी भी समय राष्ट्रपति को अपना इस्तीफा दे सकते हैं, लेकिन उन्हें धारा 14 में बताए गए तरीके से हटाया जा सकता है।
